Spill Kit Maintenance: Inspection Schedule and Replacement Guide

A spill kit that has not been properly maintained is worse than no spill kit at all — it creates a false sense of security. In the event of a real spill, a depleted or degraded kit can mean the difference between a contained incident and a reportable pollution event or a RIDDOR injury. Under UK law, employers have a duty to ensure that emergency equipment is fit for purpose, which means your spill kits must be regularly inspected, maintained, and replenished.

The Legal Duty to Maintain Emergency Equipment

The Health and Safety at Work etc. Act 1974 places a general duty on employers to provide and maintain safe plant and equipment. The Provision and Use of Work Equipment Regulations 1998 (PUWER) reinforce this by requiring that all work equipment — including spill response equipment — is maintained in an efficient state and in efficient working order. The Management of Health and Safety at Work Regulations 1999 further require that emergency procedures and the means to carry them out are properly resourced and functional.

If an Environment Agency inspector or HSE inspector visits your site and finds spill kits that are incomplete, inaccessible, or unusable, this will be treated as a serious non-compliance.

What to Check During an Inspection

A thorough spill kit inspection should cover the following:

  • Location and accessibility: Is the kit in its designated location? Is it clearly signed and accessible without obstruction? Can it be reached within seconds in an emergency?
  • Seal and packaging: Is the bag or container sealed and undamaged? A broken seal may indicate the kit has been tampered with or partially used.
  • Contents vs. manifest: Every kit should have a contents list. Verify that every item is present: absorbent pads, socks, pillows, disposal bags, ties, gloves, and goggles as applicable.
  • Absorbent condition: Absorbents can degrade if stored in damp or UV-exposed conditions. Check for discolouration, clumping, or brittleness.
  • Suitability for current hazards: Has your site introduced new chemicals since the kit was selected? Ensure the kit type (oil-only, chemical, universal) still matches the hazards present.

When to Replace Contents

Replace absorbent contents if they show any signs of degradation, or immediately after any use. Most quality absorbents have a shelf life of 3–5 years when stored correctly (dry, cool, away from UV), but always follow the manufacturers guidance. It is far more cost-effective to replace absorbent pads and socks on a routine schedule than to discover during an incident that your kit is ineffective.

Building a Maintenance Log

Keep a written maintenance log for every spill kit on site. Record the inspection date, inspectors name, findings, and any actions taken. This log is your evidence of compliance in the event of an audit or incident investigation. Store logs alongside your spill response plan.
